The First Circuit is considering whether or not Maine’s requirement that all medical cannabis companies be owned by state residents improperly hinders interstate commerce.
The bill with the best opportunity to become law, say advocates, is SB261, currently waiting for a vote in the House after passing the Senate.
“We need to make sure people aren’t gaming the system. Tax returns tell a very vivid story,” said one Social Equity Council member.
The ordinance increases the number of adult use retail licenses to 100 and creates a lottery system to award licenses to applicants who have not found a location to operate.
Using New Jersey as an example, Maryland could be years away from selling the first product in stores.
Vermont currently has five medical cannabis dispensaries in operation, all of which are vertically integrated operations and all are at least partially under the control of out-of-state companies.
Etain is New York’s only women-owned and operated cannabis business and one of the first five organizations to receive a medical license. Its four dispensaries are located in Manhattan, Kingston, Syracuse, and Westchester.
That bill, which is the third since 2019 to pass the House, would still need to pass the state Senate, which was where previous efforts to legalize have died.
In the meantime, no recreational licenses have been issued within Detroit city limits, although it continues to approve medical licenses.
